Jompos Logistics ("Jompos" or "We" or "Our") is committed to ensure that your Personal Data is protected in accordance with the Personal Data Protection Act 2010 (PDPA 2010) which was enacted by the Malaysian Government to regulate the processing of personal data.
This Privacy Policy sets out our policy, practice and operating procedures in collecting, using, processing and disclosing your Personal Data, and your rights in respect of your Personal Data that are being collected, used, processed and disclosed by us.
1. INTERPRETATION
"The Business" entails Jompos, which is owned and operated by Jompos Logistics.
"Jompos", "We", "us" and/or "Our" entails the Business;
"Personal Data" means any information in term of commercial transactions that in connection , either directly or indirectly with the data subject, who is identified or identifiable from that information or that and other information in our possession, including any sensitive personal data and expression of opinion about the data subject, which we collect;
"Sensitive Personal Data" indicates any personal data consisting of information as to the data subject's physical or mental health or condition, political opinions, religious, beliefs or other beliefs of similar nature, and the commission or alleged commission of any offence;
"Data Subject" means an individual who is the subject of the Personal Data;
"Data Processor" in relation to Personal Data, entails any person, other than our Employee, who processes the Personal Data solely on behalf of us but not for any of their own proposes.
2. PERSONAL DATA
2.1 Personal Data of User that We collect includes but not limited to the following:
- personal details, for instance, name, identity card number, age, birth date, address, gender, occupation, telephone number, mobile phone number, email address, credit card number(s), debit card number(s) and etc;
- your image captured by camera and/or video recorder when you attend our promotional events or other events held and organised by us; and/or
- information automatically collected when you visit our website, for instance, IP Address, web browser, transaction information and other information.
2.2 Please take note that certain Personal Data requested by us are mandatory, which you shall provide and agree to the processing of such mandatory information by us, in order to successfully proceed your request, transaction, order and etc as stated below. In case of failing to provide mandatory information to us and/or refusal to disclose by you, We may not be able to:-
- conduct or complete the relevant sale and purchase transaction with you;
- process or perform your request;
- approve or continue any of your subscription;
- process your application for any contest and/or complementary gift(s);
- provide you with the information, update, products and/or services that you have requested; and/or
- allow you to access onto and/or log into our Website.
3. METHOD OF PERSONAL DATA COLLECTION
3.1 Your Personal Data is being collected when:-
- you apply to be our member, subscribe to our Newsletter, obtain information and/or updates on any products and/or services and/or purchase or order Goods on our Website;
- you enter contests or respond to our surveys, promotions and/or questionnaires or comment your opinions, whether physically or electronically;
- pursuant to any inquiry, complaint, request or communication made with or to us, whether physically or electronically, including via our website or other platforms;
- you attend events held and organised by us.

- through the use of cookies on our website and/or other internet platforms.
4. PURPOSES OF COLLECTING, PROCESSING AND USING YOUR PERSONAL DATA
4.1 We are collecting, processing and using your Personal Data:-

- to process your applications, inquiries, requests and purchases;
- to provide information and updates in relation to products and services;

5. SENSITIVE PERSONAL DATA
5.1 If you do not want your Sensitive Personal Data to be collected by us, please do not submit it.
5.2 If you do choose to submit your Sensitive Personal Data to us as requested, such data shall be deemed to be and will be treated by us as Personal Data which will be subjected to the terms and scope of this Privacy Policy, including for the collection, processing, using and disclosing of your Personal Data.
6. DISCLOSURE
6.1 To facilitate the purposes stated above, We may disclose your Personal Data to the following classes of Third Parties:-
- our subsidiary companies and businesses, if any;
- payment gateway company and/or financial institution(s) in relation to credit card, debit card and bank transfer transactions and issues;
- our advisors, auditors, consultants, contractors, sub-contractors, products and services providers, solely on a need to know basis;
- regulatory authorities, enforcement agencies and any relevant parties in connection with any legal proceedings;
- any actual or potential assignee, transferee, or acquirer of the Business or pursuant to any business restructuring exercise.

7.1 We will adopt and use all reasonable and practical endeavours to protect and secure all Personal Data provided by you in order to prevent loss, unlawful disclosure and misuse of your Personal Data, by ensuring the processing of your Personal Data is conducted in the following manner:-
- all personal data is only processed by our authorised personnel;
- we maintain physical security such as locks and security systems over Personal Data that are being keep in paper and electronic data storage;
- we maintain computer and network security, for instance, use of anti-virus programmes, passwords, and etc;
- we maintain and monitor our online security systems to ensure your Personal Data is protected; and/or
- we will reasonably endeavor to impose and ensure the same level of obligations on our service providers or other data processors, that may process your Personal Data.
8. LINKS TO OTHER SITES
8.1 Our website may contain links to other websites. Please be aware that we are not responsible for the privacy practice and/or the content of the linked sites. We encourage you to read the Privacy Policy of each site that collects information from you. Our Privacy Policy is solely applied to the information collected by us. Should you have any reason you choose to access other websites linked to our website, you do so at your own risk. We shall not be held responsible to the way of Personal Data being collected, used, disclose or protected from those websites.
9. USE OF COOKIES
9.1 When you visit our website or use our services through our website, our website may create a "cookie". A "cookie" is a piece of information stored on our storage drive containing information of your computer. The "cookie" enables our system to recognise your browser and remember your name, billing information and other information so that you would not have to retype it on your next visit.
9.2 A session ID cookie expires when you close your web browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove or clear the persistent cookie by following directions / instructions provided in your respective web browser.
10. DURATION OF PERSONAL DATA BEING KEPT BY US
10.1 Your Personal Data is kept by us for the duration that is necessary to carry out the purpose of which your Personal Data was collected for the intended purposes set out in this Privacy Policy. We are bound by legal, tax, regulatory and industry requirements and/or guidelines for keeping records and retention of your Personal Data.
11. THIRD PARTY PERSONAL DATA
11.1 You warrant and represent that you have obtained the required consent of the relevant third parties, where you provide Personal Data of Third Parties to us, for the processing and using of the Third Parties' Personal Data in accordance with the terms of this Privacy Policy, and that all requirements of the Personal Data Protections Act 2010 have been fulfilled in your collection and provision of the relevant Third Parties' Personal Data.
12. ACCESS, MODIFY AND RECTIFY YOUR PERSONAL DATA
12.1 You are responsible for providing accurate, complete, up-to-date information about yourselves. You shall rectify or modify such information by contacting us or by submitting fresh information to us once such information becomes incorrect or outdated.
12.2 If you wish to access or modify your Personal Data, you must log into your account on our website or inform us by way of writing at the address set out in Section 14 below. Please provide us with proof of your identity, address and sufficient information for identification purposes when you submit your request to us.
12.3 Upon receiving your written notice or request, we may:-
- in certain circumstance refuse your request to access or rectify your Personal Data. In the event of any refusal, we will notify you with or without reason for such refusal; and/or
- charge an administration fee for processing your request for access or rectification or modification.
13. LIMIT THE PROCESS OF PERSONAL DATA
13.1 If you do not wish to receive offers, promotions and marketing materials on our products and services, please follow the instructions in Section 15 below. If you would like us to cease processing your Personal Data for any other specified purpose or in a specified manner, please notify us in writing to the address set out in Section 14 below. In the absence of such written notice, you are deemed to have consented to the processing, usage, dissemination of your Personal Data in the manner, to the extent and within the scope of this Privacy Policy.
13.2 In the event you do not consent to the processing of your Personal Data as above, we may not be able to perform your request or certain transactions, as stated in Section 2.2.
14. OPT OUT / UNSUBSCRIBE OPTIONS
14.1 Email
- If you do not wish to receive any promotional or marketing emails from us, please click the "Unsubscribe" link attached in the email sent from us to you; or
- you can contact our Client Support Centre.
14.2 Direct Mail / Telemarketing
- If you do not wish to receive any mails or calls from us with regards to our available promotions and/or marketing informations, please write to our Client Support Centre.
16. OUR PRIVACY POLICY
16.1 We reserve the right to modify and supplement this Privacy Policy from time to time. All amendments to the Privacy Policy will become effective upon notices as the followings:-
- We will post a notice on the changes to this Privacy Policy on our Website at jompos.com for a period of 3 months after the amendments are made; the revised version of this Privacy Policy will be made available on the website.
- Following the mentioned notification, the continued use of our website and our products and services, and provision of Personal Data by you and/or absence of notification by you in accordance with the Privacy Policy, you are deemed to accept any and all the amendments that have been made.
17. CONFLICT
17.1 In the event of any inconsistency between this Privacy Policy, and any consent to collection, use and disclosure of your Personal Data given by you prior to this, this Privacy Policy shall prevail.
17.2 In the event of discrepancies or inconsistencies between the English Version and Chinese Version of this Privacy Policy, the English Version shall prevail.
